TERMS OF SERVICE

OVERVIEW

Welcome to The We Went Anyway Club! When we say "we," "us," or "our," we're talking about The We Went Anyway Club. We run this store and website (the "Services") to bring you quality gear that celebrates your brave parenting choices. We're powered by Shopify, which handles the technical heavy lifting so we can focus on making shirts that get you.

These Terms of Service (the "Terms") lay out how everything works between us. We know legal documents aren't exactly campfire reading, but they're important—they cover your rights, our responsibilities, and what happens if things go sideways.

The short version: By using our site or buying our stuff, you agree to these Terms and our Privacy Policy [LINK]. If you don't agree, please don't use our Services. We'd miss you, but we get it.


SECTION 1 - ACCESS AND ACCOUNT

By using our Services, you're confirming that you're at least 18 (or whatever the age of majority is where you live) and that if your kids use your device to browse our store, you're cool with that.

When you order from us, we'll ask for information like your email, billing details, and shipping address. You're promising that everything you give us is accurate and up-to-date. Keep your account info secure—you're responsible for everything that happens under your account. Don't share your login, sell your account, or do anything weird with it.


SECTION 2 - OUR PRODUCTS

We work hard to show you exactly what our products look like, but screens vary—your laptop might show colors differently than your phone, and neither might be perfect. We can't guarantee that what arrives will look exactly like it did on your screen, but we promise it'll be quality gear built to last.

Product descriptions can change, we might discontinue items, and we reserve the right to limit quantities or restrict sales to certain regions if needed. It's our store, but we'll always be straight with you about what's available.


SECTION 3 - ORDERS

When you place an order, you're making us an offer to buy. We'll accept or decline that offer at our discretion (we're not trying to be jerks—sometimes inventory gets funky or payment doesn't go through). Your order isn't official until we confirm it and process your payment.

Important: Double-check your order before hitting submit. Once we've accepted it and started printing your shirt, we probably can't cancel or change it. We're a small operation working with print-on-demand partners, not Amazon. If something goes wrong on our end, we'll email you at the address you provided.

Returns and exchanges are covered by our Refund Policy [LINK].

You're buying this stuff for yourself or your family, not to resell commercially. If you want to buy in bulk for resale, contact us at Support@WentAnyway.com and let's talk.


SECTION 4 - PRICES AND BILLING

Prices can change without warning (we'll try to keep things stable, but costs fluctuate). You'll pay whatever the price was when you placed your order—that's what'll be in your confirmation email. Prices don't include taxes, shipping, or customs fees unless we explicitly say they do.

Our online prices might differ from what you'd see in physical retail stores or other marketplaces. We sometimes run promotions with their own terms—if those conflict with these Terms, the promotion terms win.

Your billing responsibilities: Keep your payment info current and accurate. You're confirming that (a) your credit card info is legit, (b) you're authorized to use that card, (c) your card company will approve the charges, and (d) you'll pay everything including shipping and taxes.


SECTION 5 - SHIPPING AND DELIVERY

We'll get your order out as fast as we can, but we're not responsible for shipping delays once it leaves our hands. Delivery estimates are just that—estimates. Weather, customs, carrier issues, acts of nature, toddler-caused apocalypses—we can't control any of it.

Once we hand your package to the carrier, it's technically yours (in legal speak: title and risk of loss pass to you). If something goes wrong in transit, contact us at Support@WentAnyway.com and we'll help however we can.


SECTION 6 - INTELLECTUAL PROPERTY

Everything on our site—the designs, logos, text, images, graphics, "We Went Anyway" name, all of it—belongs to The We Went Anyway Club or our licensors. It's protected by U.S. and international intellectual property laws.

What you can do: Use our site to shop and browse for personal use.

What you can't do: Copy our designs, reproduce our content, use our trademarks, or do anything commercial with our stuff without written permission. That includes screenshots of our designs to make knockoffs. Don't be that person.

We take this seriously because this is how we support our small business and keep making gear for adventurous parents. Unauthorized use could violate federal and state laws. All rights not specifically granted here stay with us.


SECTION 7 - OPTIONAL TOOLS

We might offer access to third-party tools (like customer service chatbots or review platforms) as part of your shopping experience. We don't control these tools and provide them "as is" without any promises about how they'll work.

If you use them, you're doing so at your own risk. Make sure you understand the third party's terms before you dive in. We're not responsible for any issues that come up.

New features and tools might show up in the future—those will be part of the Services and covered by these Terms.


SECTION 8 - THIRD-PARTY LINKS

Our site might link to other websites or include embedded content from third parties. We're not responsible for what's on those sites or how they operate.

If you click away from our site, you're on your own. We're not liable for anything that happens on other websites, including purchases or issues with their products or services. Check their policies before you do business with them, and direct any complaints to them, not us.


SECTION 9 - RELATIONSHIP WITH SHOPIFY

Shopify powers our store's technical infrastructure, but when you buy from us, you're buying from The We Went Anyway Club directly. Shopify isn't responsible for your order, the products, customer service, or anything related to your purchase.

SECTION 10 - PRIVACY POLICY

SECTION 11 - FEEDBACK

If you send us ideas, suggestions, reviews, photos of your adventures, or any other content ("Feedback"), you're giving us permission to use it however we want—in marketing, on social media, in our store, everywhere. We won't pay you for it, and we don't have to keep it confidential or even respond to it (though we love hearing from you).

What you're promising when you submit Feedback:

  • You own it or have the rights to share it
  • You've disclosed any compensation you received for it
  • It complies with these Terms
  • It's not illegal, threatening, defamatory, obscene, or violating anyone else's rights
  • It doesn't contain viruses or malware
  • You're not pretending to be someone else

We might remove Feedback that's offensive, unlawful, or problematic at our discretion. You're responsible for what you submit.


SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Sometimes we make mistakes—typos in product descriptions, wrong prices, incorrect availability. We reserve the right to fix any errors and update information at any time, even after you've ordered. We'll do our best to make it right.


SECTION 13 - PROHIBITED USES

Don't use our Services to:

  • Break any laws (federal, state, local, international)
  • Violate our intellectual property or anyone else's
  • Harass, harm, or insult people (including our team)
  • Send spam, junk mail, or unsolicited promotions
  • Impersonate others or send false information

  • Generally be a jerk or do anything that harms our business, Shopify, or other users

If we determine you've violated these Terms, we can suspend or terminate your account without notice.


SECTION 14 - TERMINATION

We can end this agreement or your access to our Services at any time without notice. If we do, you're still responsible for any amounts you owe us.

Even after termination, sections covering Intellectual Property, Feedback, Warranties, Liability, Indemnification, and other provisions that should naturally survive will still apply.


SECTION 15 - DISCLAIMER OF WARRANTIES

Here's the legal part we have to say clearly:

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We don't guarantee that the site will be uninterrupted, error-free, or completely secure. We've done our best to represent our products accurately, but we can't promise they'll meet your exact expectations.

Some states don't allow warranty disclaimers, so this might not fully apply to you depending on where you live.


SECTION 16 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, THE WE WENT ANYWAY CLUB, SHOPIFY, AND ALL OUR RESPECTIVE PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.

This applies whether the claim is based on contract, tort, negligence, strict liability, or anything else, even if we've been told these damages could happen.


SECTION 17 - INDEMNIFICATION

If your use of our Services or violation of these Terms causes legal issues, you agree to defend us and cover any costs, including reasonable attorney fees. We'll let you know if a claim comes up (though if we forget, you're not off the hook unless it materially hurts your defense).

We might control the defense at your expense, but we won't settle anything requiring action from you without your consent. You agree to cooperate with us in defending any claims.


SECTION 18 - SEVERABILITY

If any part of these Terms is found to be unenforceable, that part will be limited to the extent possible, and the rest of the Terms stay in effect.


SECTION 19 - WAIVER; ENTIRE AGREEMENT

If we don't enforce a term immediately, that doesn't mean we've given up the right to enforce it later.

These Terms (along with our Privacy Policy and Refund Policy) represent the complete agreement between us regarding your use of the Services. They replace any prior agreements or conversations.

You can't transfer these Terms or your account to anyone else without our written permission. We can transfer or assign these Terms without notifying you.

These Terms are governed by the laws where The We Went Anyway Club is headquartered. Any disputes will be resolved in the courts of that jurisdiction, and you consent to that venue and jurisdiction.

By continuing to use our Services after changes take effect, you're agreeing to the updated Terms. If you don't agree, stop using the Services.
